Terms of Service
The short version
- Castaway is free to play. Have fun and be decent.
- Don't cheat, hack, or use offensive captain names.
- In-game cash, boats and gear are just for fun: they have no real-world value.
- The game is provided as-is and may change over time.
These Terms of Service (“Terms”) are an agreement between you and Castaway (“we”, “us”) for using the Castaway game and website (the “Game”). By playing or creating an account, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Game.
1. Who can play
You must be at least 13 years old to create an account. If you're under 18, you need permission from a parent or guardian, and they agree to these Terms on your behalf. Anyone can play as a guest without an account.
2. Your account
- Give accurate information when signing up, and keep your password private. You're responsible for what happens on your account.
- One person per account. Don't share, sell or transfer accounts.
- Let us know at playcastawaysupport@gmail.com if you think someone else has accessed your account.
3. Captain names and conduct
When you play, don't:
- Pick a captain name that is offensive, hateful, sexual, threatening, impersonates someone else, or contains personal information.
- Cheat, use bots, edit your save outside the game, or exploit bugs to gain cash, items or progress. If you find a bug, please report it.
- Try to break into, overload, disrupt, or reverse-engineer the Game, its servers or other players' accounts.
- Use the Game for anything illegal.
We may rename, reset or remove anything that breaks these rules.
4. Virtual items
Cash, boats, rods, lures, catches, records and any other in-game items have no real-world monetary value. They can't be exchanged for real money or sold, and you don't own them. You have a limited license to use them inside the Game. We may adjust prices, balance or items, or reset progress when needed to fix bugs or keep the Game fair.
5. Our game
The Game, including its code, art, design, names and logos, belongs to us. We give you a personal, non-commercial, revocable license to play it. You may share screenshots and videos of your gameplay. You may not copy, resell or republish the Game itself.
If you send us ideas or feedback, we may use them freely without owing you anything.
6. Changes and availability
We're always working on the Game and may add, change or remove features at any time. We can't promise the Game will always be available or error-free, and we may pause or end the service. We'll try to give notice in the game before shutting it down.
7. Ending your account
You can stop playing at any time and ask us to delete your account by emailing playcastawaysupport@gmail.com. We may suspend or delete accounts that break these Terms. Sections 4, 5, 8, 9 and 10 continue to apply after your account ends.
8. No warranty
The Game is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that your progress will never be lost. Fishing tips in the Game are for entertainment only, not real-world advice.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost data or progress, arising from your use of the Game. Because the Game is free, our total liability to you for any claim is limited to $0, or the lowest amount allowed by law. Some places don't allow these limits, so they may not fully apply to you.
10. Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New York, and you and we agree to their jurisdiction. Before going to court, please email us first. Most problems can be sorted out quickly.
11. Changes to these Terms
We may update these Terms from time to time. We'll change the date at the top of this page and, for significant changes, let you know in the game. Continuing to play after an update means you accept the new Terms.
